The Georgia Department of Law’s Consumer Protection Unit (“CPU”), on behalf of the State of Georgia, has reached an agreement with Fractional Property Services (“FPS”) and owners Matthew Delatorre and Joshua A. Wright.  FPS offered to market vacation properties for consumers to rent their timeshares.  Consumers stated that the business claimed to have a renter for their timeshare, but required the consumer to pay an upfront fee.  Consumers further stated that the business failed to rent or sell their timeshare as agreed and refused to refund the paid fee.

On March 31, 2017, FPS, Delatorre and Wright entered into a Consent Judgment and Injunction in which they have agreed to cease operations, and to pay $118,429 in restitution to consumers who purchased services and $305,000 in fees and penalties. 

Eligibility

If FPS did not provide or perform services for you as promised between August 1, 2014, and March 31, 2017, you may be eligible for restitution under the Consent Order.  To be eligible for restitution:

  1. Your contract with FPS must have been entered between August 1, 2014 and March 31, 2017;
  2. The claim must be based upon a complaint that FPS did not provide or perform services as represented or promised by FPS; and
  3. You must have suffered a verifiable out-of-pocket (monetary) loss.

To be considered for a refund, you will need to complete this claim form and submit it to the Georgia Department of Law in one of the following ways to be received no later than December 31, 2018

Consumers who fail to submit all of the required information to us by December 31, 2018, will forfeit all claims to which they would be eligible under this settlement agreement.
